McLean Class Action for Federal Day Schools Objection Period Deadline is May 3

The Mclean Class Action for Federal Day Schools will offer some former day school students compensation as part of a proposed settlement agreement. The Mclean Class Action for Federal Day Schools excludes many schools and limits eligible years. Former students can object to the proposed settlement if they are not in agreement with any or all of the terms. Former students must object by May 3, 2019.

To object, you must submit an Objection Form to Class Counsel that includes the following:

➢ Your name, address, and telephone number;

➢ A statement saying that you object to the Indian Day School proposed Settlement;

➢ The reasons you object to the proposed Settlement, along with any supporting materials;

➢ The Indian Day School that you attended and the years that you attended; and

➢ Your signature.

Objections must be mailed or emailed, postmarked by May 3, 2019 to:

Which schools are excluded in the settlement agreement?

The Mclean Class Action will only offer compensation to students who attended Federal Day Schools as listed in Schedule K of the proposed Settlement Agreement which excludes the following schools;

  • Pallakvik/Padloping Island
  • North Camp, Belcher Islands
  • Gordon Robertson Education Centre, Frobisher Bay/Iqaluit
  • Keewatin Regional Education Centre, Rankin Inlet
  • Sir John Franklin High School, Yellowknife
  • St. Patrick’s Separate School, Yellowknife
  • Churchill Vocation Centre, Churchill

Which Schools are included in the settlement agreement?

Under the current Mclean Class Action compensation will be offered to only students who attended federal day schools during the following dates, which is not based on the dates of the schools operations;

  • Baker Lake – January 1957 to April 1, 1970
  • Belcher Island South Camp – September 20, 1960 to April 1, 1970
  • Broughton Island – September 1959 to April 1, 1970

Is objecting to the settlement agreement the same as Opting Out?

No, if you object to the Settlement Agreement, you should do so by submitting a Notice of Objection and, if you desire, appearing at the Settlement Approval Hearing. All submissions will be reviewed in court and inform the judgement.

Who makes the final decision to approve the settlement agreement?

Although Class Members may make objection to the proposed settlement agreement, the final decision on approval of the settlement is that of the judge alone.

Can I speak at the Approval Hearing?

Class Members may speak at the approval hearing. If you are a Class Member, you can ask the court for permission to speak at the approval hearing. To do so, please indicate on your Objection Form that you would like to speak at the approval hearing. NTI has some travel funds available for former students to attend.
