Aboriginal organizations in Canada will facilitate the pooling of Credits where former residential school students decide to pool Credits for a group culture, language or reclamation of history program or service. Toll-free numbers of the aboriginal organizations are;

C. ELIGIBILITY
Every CEP Recipient will be eligible to use the Personal Credit, including those who have become deceased since receiving CEP.
79,000 CEP Recipients across Canada will be eligible, including approximately 2400-3000 Inuit who are NLCA Beneficiaries.
For those CEP Recipients who have passed away, the Personal Representative for Estate will have to be contacted by Family Members to access the Credit or for requests for transfers of the Credit to Family Members.
The Personal Representative for Estate would be the estate administrator appointed by the CEP Recipient while still alive or an approved administrator after the CEP Recipient passed away. In some cases, it would be a lawyer, an assigned family member or the Public Trustee.

Family Members able to receive transfers of the Credit (whether CEP recipient alive or deceased);
- the spouse, Child, grandchild, parent, grandparent or sibling of an Inuk CEP Recipient;
- the spouse of a Child, grandchild, parent, grandparent or sibling of an Inuk CEP Recipient;
- a former spouse of an Inuk CEP Recipient;
- the Child, or other lineal descendent of a grandchild of an Inuk CEP Recipient
- a person of the same or opposite sex to an Inuk CEP Recipient who cohabited for a period of at least one year with that Inuk CEP Recipient immediately before his or her death;
- a person of the same or opposite sex to an Inuk CEP Recipient who was cohabiting with that Inuk CEP Recipient at the date of his or her death and to whom that Inuk CEP Recipient was providing support or was under a legal obligation to provide support on the date of his or her death;
- any other person to whom an Inuk CEP Recipient was providing support for a period of at least three years immediately prior to his or her death;
- a person of the same or opposite sex to an Inuk CEP Recipient who cohabited for a period of at least one year with that Inuk CEP Recipient immediately before the Inuk CEP Recipient delivered a Personal Credits Acknowledgement Form to the Agent of the Trustee;
- a person of the same or opposite sex to an Inuk CEP Recipient who was cohabiting with that Inuk CEP Recipient immediately before the Inuk CEP Recipient delivered a Personal Credits Acknowledgement Form to the Agent of the Trustee and to whom that Inuk CEP Recipient was providing support or was under a legal obligation to provide support; and
- any other person to whom an Inuk CEP Recipient was providing support for a period of at least three years immediately prior to delivering a Personal Credits Acknowledgement Form to the Agent of the Trustee.
D. OPTIONS
CEP Recipients will have options to use the Credit;
- not use the Credit at all – the unused funds will be remitted back to the CEP Designated Amount Fund to be transferred to the National Indian Brotherhood Trust Fund and and the Inuvialuit Education Fund after 2015 for the benefit of all CEP Recipients, for educational purposes;
- CEP Recipient uses all of the Credit for himself or herself, up to a maximum of $3000.00 to be applied towards one institution of CEP Recipient’s choice;
- CEP Recipient divides the Credit between two institutions of CEP Recipient’s choice, up to a maximum of $3000.00 in total;
- CEP Recipient partially uses Credit and transfers the remaining Credit to one family member, up to a maximum of $1500.00 each;
- CEP Recipient partially uses Credit and transfers the remaining Credit to two family members, up to a maximum of $1000.00 each;
- CEP Recipient chooses not to use the Credit and transfers all of the Credit to one family member, up to a maximum of $3000.00;
- CEP Recipient chooses not to use Credit and transfers all of the Credit to two family members, up to a maximum of $1500.00 each;
- CEP Recipient pools Credits with other CEP Recipients for a group educational program or service, including for a culture, language or reclamation of history program.
Note: The maximum number of Family Members which can receive the transfer are two family members where original CEP Recipient does not use the Credit. This also applies to Transfers where CEP Recipient has passed away.
It is important for Family Members to discuss amongst themselves which of the Family Members may benefit from the transfer of the Credit.
E. INSTITUTIONS
CEP Recipients will have to decide first whether they want to attend an educational program or service, including a culture, language or history program or service, to apply the Credit to. CEP Recipients can choose from existing institutions that currently provide education/cultural program or services.
Crawford Class Action Services will approve payments of the Credit to the following institutions where CEP chooses to attend;
- Community organizations, associations and non-profit entities that provide Inuit cultural, language and reclamation of history program or service;
- Post-secondary institutions such as universities and colleges;
- Trade, Technical or Literacy Schools;
- Elementary and Secondary Schools;
- Daycares and Preschool Programs;
- Online Courses or Distance Education Programs
Note: The maximum Credit is $3000.00. However, the actual expenses will be at the discretion of the institution to determine to charge against the Credit for providing the educational/cultural program or service. Thus, if an institution charges $2500.00 for a course or program, as an example, a cheque will be issued to the institution in that amount, and not $3000.00.
F. EXPENSES ELIGIBLE
The expenses in which the Credit will cover for, will be the following;
- Tuition and Associated Fees
- Books
- Transportation
- Accommodation and Lodging
- Meals
- Program Supplies
- Computers
- Incidental Costs
The expenses will be at the discretion and supply of the existing educational or cultural institution. Thus, it is best for the CEP Recipient or the Family Member to understand what the institution will be providing or supplying, as well as discuss expenses the institution would be charging, before deciding which educational/cultural program or service to attend.
Aboriginal liaison officers can assist CEP Recipients facilitate the pooling of Credits for a cultural, language or reclamation of history program or service and work with existing institutions to maximize the benefit of the Credit to the CEP Recipient or Family Member.
G. PROCESSING OF FORMS
Crawford Class Action Services mailed the Acknowledgment Forms and the Information Package to every individual CEP Recipient, with a specific bar code for each Acknowledgement Form.
If the CEP Recipient has changed its’ mailing address since receiving CEP, he or she must call Crawford Class Action Services at 1-866-343-1858 to notify them of the change of address to send the Acknowledgment Form to.
Crawford Class Action Services can provide the Instruction Guide in the Inuit Language of choice WHERE REQUESTED by the CEP Recipient. The CEP Recipient should call Crawford Class Action Services’ toll-free number and request for a copy to be mailed to the CEP Recipient.
CEP Recipients or Personal Representative for Estates should mail back the completed Acknowledgment Form to Crawford Class Action Services once it has been decided how the Credit will be applied and by whom.
Crawford Class Action Services will send another form called the Redemption Form to the CEP Recipient or Personal Representative for Estate. The Redemption Form is to be completed by the CEP Recipient and the Institution – the Redemption Form is to confirm the election of use of Credit, the choice of institution, and to begin the process of payment to the institution.
H. DEADLINES
The Deadlines to submit Forms back to Crawford Class Action Services will be the following;
October 31, 2014 – Acknowledgment Form (by CEP Recipient)
December 1, 2014 – Redemption Form (by CEP Recipient and/or Institution)
The Deadlines apply only to the mailing of the Forms – the timing of the education/cultural program or service the CEP Recipient or Family Member will be attending will depend on the timing of the course or upon agreement between CEP Recipient/Family Member and the institution being attended.
I. APPEALS
Appeals can only be made by the original CEP Recipient or the Personal Representative for Estate. Appeal Forms will be provided by Crawford Class Action Services. The decisions of the 3-panel member Appeals and Advisory Committee are final.
CEP Recipients will have 30 days to appeal decisions of Crawford Class Action Services;
- where it does not approve a Family Member as being eligible to receive a Credit transfer; or
- an entity is not approved as eligible institution; or
- an educational program or service is not approved.
